Status: DRAFT FOR LAWYER REVIEW ONLY Not legal advice. This document is a working template for counsel to adapt before any party is asked to sign. Jurisdiction placeholder: Laws of the Netherlands or Belgium (choose one) / EU consumer and data-protection rules as applicable. Industry scope: Adult entertainment casting, wardrobe / look modeling, and related creator desk work. 18+ only.


Cover notice (keep on every circulating copy)

  1. This is a draft. Numbers in brackets `[ ]` are editable commercial defaults.
  2. No signature is required to apply, join the desk, or receive mediated introductions.
  3. Real wet-ink or e-signatures are intended only after the desk has counsel-approved final text and the operating entity is ready to contract formally.
  4. Until then, day-to-day bookings use short written offers (email or booking sheet) that restate rate, scope, travel, and hard limits.

Parties

RoleDefined as
**Model**The natural person, aged 18+, who receives mediated placement offers.
**Desk / Manager**The intermediation desk operating under the Elite Adult Casting brand (legal entity name **TBD** — placeholder: “[Desk Legal Name]”).
**Studio / Client**An adult studio, wardrobe brand, creator project, or other production client that books a paid day through the Desk.

This Agreement (when finalized) may be two-party (Model ↔ Desk) with Studio terms on each booking sheet, or three-party for a specific booking. Counsel to choose the cleanest structure for NL/BE.


1. Purpose

The Desk mediates introductions and booking coordination between Model and Studios / Clients. The Desk is not an employer of Model by default, and not a dating, escort, or companionship service.

Work in scope includes, as Model elects in writing:

  • Wardrobe / look / product modeling days
  • Adult studio performance days (only when Model opts in)
  • Related creator-desk or remote look work when agreed in writing

2. What the Desk does

  1. Maintain Model’s placement preferences (city hubs, lane: wardrobe / adult / both).
  2. Mediate introductions to vetted Clients only after written scope and rates are proposed for Model’s review.
  3. Coordinate call sheets, travel notes, and hard-limit reminders.
  4. Help chase payment confirmation for booked paid days when the booking runs through the Desk’s process.
  5. Keep Model’s file private by default (not published on public roster) unless Model opts in.

The Desk does not:

  • Guarantee bookings or income
  • Charge Model a roster, joining, or “agency registration” fee
  • Force exclusivity (see §7)
  • Book Model for scenes or days Model has declined

3. Model rights

  1. Decline any offer for any reason, without penalty to future consideration.
  2. Hard limits stated by Model are binding for that booking; on-set pressure to expand scope is not permitted. Fresh written OK is required for nude or harder beats if not already in the booking sheet.
  3. Wardrobe-only is welcome; adult studio days are never assumed from an application alone.
  4. Private by default — profile and contact details are not sold or cold-shared with Clients outside mediated intros.
  5. Model may update city hubs, lane, and limits at any time via the applicant desk or email.
  6. Model may end the intermediation relationship under §9.

4. Studio / Client obligations (per booking)

Before call time, Client provides in writing:

  1. Scope of work (wardrobe / adult / both; scenes or looks as applicable)
  2. Day rate (or hourly / package), currency, and overtime rules if any
  3. Hours, location, travel / accommodation terms
  4. Usage / release outline (what is filmed or photographed and where it may appear)
  5. Confirmation that Model’s hard limits will be respected

Client must:

  • Complete lawful age / ID checks where required (Model is and remains 18+)
  • Pay Model’s agreed day rate as set out in the booking sheet
  • Pay the Desk’s booking fee as set out in §6
  • Not contact Model off-desk to bypass fees for the same mediated introduction within `[12]` months (counsel to tune)

5. Payment flow (booked paid days only)

Default commercial model (preferred — model keeps 100% of day rate):

  1. Client pays Model the full agreed day rate (or pays via Desk escrow / invoicing if used).
  2. Client separately pays Desk a booking / intro fee equal to `[18]%` of Model’s day rate for that booked day (editable band 15–20%).
  3. No Desk commission on applications, profile views, or declined offers.
  4. Fees apply only to booked paid days (and late-cancel fees if counsel adds a cancel schedule).

Example (editable): Model day rate €600 → Model receives €600; Client also pays Desk €108 (18%); Client total labour+desk for that day €708 before travel/other costs.

Travel, kit, testing, or usage buyouts are extra when written on the booking sheet; they are not automatically commissionable unless listed.


6. Fees — summary table

Documented alternative (if Client will not pay a separate fee): Model and Desk may agree in writing that Desk retains [15]% of Model’s day rate and Model keeps [85]%. Prefer the Client-pays-fee model whenever possible so Model’s headline rate stays whole.

Wardrobe-only and adult days use the same fee logic unless a booking sheet states otherwise.


7. Non-exclusivity (default)

  1. This relationship is non-exclusive by default. Model may work with other agents, platforms, or direct Clients.
  2. Optional exclusivity (territory, lane, or term) requires a separate written opt-in with clear end date and consideration — never implied by applying.
  3. City hubs are placement preferences, not exclusive territories.

8. Term

Starts on the later of (a) counsel-approved signature date, or (b) first booked paid day under this template. Continues until terminated under §9.


9. Termination

Either Model or Desk may end the intermediation relationship with [14] days’ written notice (email sufficient), or immediately for material breach (non-payment, limit violation, under-18 risk, harassment). Open booking sheets already accepted remain payable per their terms unless all parties agree otherwise.


10. Data and privacy

Personal data is processed under the Desk’s privacy notice and applicable GDPR / EU rules. Model may request access, correction, or deletion subject to legal retention (e.g. age verification, accounting). Client receives only what is needed for a mediated intro or confirmed booking.


11. Age and legality

  1. Model represents they are 18 years of age or older and will present valid ID when required.
  2. No party shall involve minors in any adult content.
  3. Parties comply with local labour, tax, and adult-industry rules in the place of performance. Tax status (employee / independent) is not fixed by this draft — counsel and local advisors to confirm.

12. Liability (placeholder for counsel)

Standard professional limitation, exclusion of consequential damages where lawful, and carve-outs for fraud, bodily injury, wilful misconduct, and GDPR fines as counsel advises. Desk is not liable for Client creative decisions on set beyond mediation duties, provided Desk acted with reasonable care.


13. Governing law and disputes (placeholder)

Governing law: [Netherlands / Belgium — choose]. Disputes: good-faith negotiation first, then [competent court / mediation centre — choose].


14. Entire agreement / booking sheets

When signed, this Agreement plus each accepted booking sheet form the contract for that day. In conflict, the booking sheet controls rate, hours, and scope for that day; this Agreement controls fee structure and ongoing desk terms.
