Intermediation agreement — draft
This page publishes the working English template so you can read it calmly. Counsel must review before anyone signs.
Talent Intermediation — VARIANT: Upfront / booking fee HIGH after testing — DRAFT
Status: DRAFT FOR LAWYER REVIEW ONLY — not legal advice. Variant code: POST-HIGH Base: Schedule or successor to CARE / TEST-LOW. 18+ only.
> Deployed mirror: includes/contracts/intermediation-variant-upfront-post-test-high-en.md
Cover notice
- Draft for counsel. Bracketed numbers editable.
- No signature required to apply.
- Use this after a successful testing period (`TEST-LOW`) or for Clients who already trust the desk and accept a higher mediation cost.
- Model is not charged a roster fee. Upfront / package fees are paid by Client unless counsel designs a rare voluntary Model micro-fee (same hard caps as TEST-LOW).
Parties
Same as CARE: Model (18+), Desk, Studio / Client.
1. When this variant applies
- Client completed a successful test under TEST-LOW, or
- Client and Desk agree in writing to start on the post-test rate card without a low trial (e.g. known agency relationship).
Model’s consent is still required for each booking’s scope and hard limits.
2. Fees after testing (HIGH)
| Item | Who pays | Who receives | Default |
|---|---|---|---|
| Model day rate / agreed fee | Client | Model | **100%** |
| Desk booking fee (ongoing) | Client | Desk | **`[20–22]%`** of Model’s day rate |
| Optional relationship package | Client | Desk | **`[€400–€750]`** one-time or annual (covers elevated intro/admin) — only if written |
| Roster / join fee from Model | — | — | **None** |
| Apply without booking | — | — | **€0** |
Example: Day rate €600 → Model €600; Client pays Desk €132 at 22% (plus package only if already agreed in writing).
Industry overlays still apply when the booking is wardrobe, adult studio, or licensed venue — see intermediation-schedule-commission-by-industry-en.md. If both POST-HIGH and an industry % apply, the booking sheet states one clear % (do not stack silently).
3. Preferred stack rule
- Booking sheet controls the single desk % and any package for that day.
- Default recommendation after success: CARE `[18]%` if Client prefers simplicity; POST-HIGH when Client demanded a higher intro cost or elevated compliance.
- For licensed NL venue bookings, prefer the IND-RLD band (`[22–25]%`) even if CARE was used for studio days — compliance burden differs.
4. Model protections (unchanged)
- Decline anytime; hard limits; private by default; non-exclusivity default.
- No Model roster fee; no forced exclusivity; no passport holding; no debt bondage; no venue “bond” from Model.
- Desk never forces the red-light / licensed-venue lane.
